failing to report jerry sandusky to police and lying about it to a grand jury will be going to trial. >> a judge ruled there was more than enough evidence of wrong doing, especially after the dramatic testimony today of assistant coach, mike mcquery. he has live with more. scott. >> well, the assistant coach testified in detail before this hushed courtroom about the attack he claims he saw, but the lawyers for these two administrators and the former vice president said that is not the story they heard when mcquery told it to them. what did penn state athletic director, tim curly, and gary schultz know and when did they know it? today lawyers for both said mike mcquery never used specific words like intercourse or sodomy when he told his story to them back in 2002.

here's what schultz's lawyer said after the hearing. >> i'm an italian from brooklyn and you may not have called the police. done what i would have done was get the boys in the car, a few baseball bats and take it to the fellow. actions speak louder than words. that didn't happen because mike mcquery never said such a thing to coach paterno or to my client. >> mcquery said he did not use graphic language with the administrators or coach paterno out of respect, but he was imfattic. there's no question that i conveyed to them that i saw jerry with a boy in the showers. and that there was severe sexual acts going on and that it was wrong and over the line. in secret transcripts revealed today, he didn't think a crime had been committed. why then did the same administrators report sandusky to his charity and take away

his locker room keys, prosecutors asked? the activity was inappropriate, but not criminal. the administrators told grand jurors. not enough for a perjury case, the athletic director's lawyer said. >> in in order for a perjury charge to stand, there must be corroboration. >> well, the judge certainly didn't agree. he ruled right away that there's more than enough evidence to take this case to trial. against the administrators for failing to act and then lying about it and no evidence in all this testimony today that joe paterno did anything more than tell his bosses and then let somebody else do something about it. reporting live in harrisburg, scott broom, 9news now. >> all right, thanks very much, scott. we're getting our first look at bradley manning since he was taken into custody for sharing military secrets with the whistle blowing website. there was a pretrial hearing today for the former army

intelligent analyst from potomac. the defense shifted the attention to the military judge in the case. standing by in maryland with more. >> the defense says not only did the military judge only grant 14 of the defense's 48 witnesses. the military judge works for the department of justice and that, the defense says, is the reason why he should be removed from the hearing. protesters rallied today as bradley manning sat inside a courtroom faced with life in prison. the 23-year-old army private is accused of handing over documents and videos to wikileaks, but his defense attorney wants the military judge off the case. he works in the department of justice. the same government agency conducting an investigation into the website wikileaks. but the prosecution argued there is no bias. because the judge's position with the doj does not involve the wikileaks or the manning cases. the judge decided to remain on

this case. >> now the defense has filed a motion to get that judge removed from this case. in the meantime, the case will continue. they are back in court tomorrow, which happens to be manning's 24th birthday and we're told 300 supporters are planning a rally and a march in his honor. 9news now. >> thanks for that report. a victory today for the man behind wikileaks. britain's highest court ruled that julian can appeal his extradition to sweden where he is accused of sex offenses. the founder says the allegations are politically motivated. he has been living in england. his arrest came shortly after wikileaks published thousands of diplomatic cables, including unflattering views of world leaders and candid assessments of security threats. >> here is welcome news in virginia. congress has reached a deal to impose a parking cap at the

mark center. the idea is to keep the traffic from getting any worse. once the mark center is fully occupied. the bill also holds the pentagon responsible for studies the traffic problem and to pay for the solution. today, virginia congressman, jim moran called it a major victory for virginia tax taxpayers and commuters. >> they have great import. basically, it means that the pentagon is responsible for building the infrastructure necessary to accommodate the 6,400 additional employees who will be moving into that building. >> the parking cap is part of a defense appropriations bill. it will go into effect as soon as the president signs it into law. it appears that congress is getting its act together. at least enough to avoid a government shutdown. as tara reports, the budget battle is far from done and the lack of a deal could mean smaller paychecks for you come

january 1. house lawmakers approved a trillion dollar plan funding the federal government through next year. >> the conference report is adopted. >> leaving senators, they'll follow suit heading off a government shutdown this weekend. but lawmakers are still battling over a bill that would extend a popular tax cut and unemployment benefits. >> putting this money in the pockets of the american people who need it so desperately and the need to spend it on necessities will inject into the economy and create more jobs. >> the payroll tax cut put an extra thousand dollars in the paychecks of 160,000 americans. those workers will take home less money in the new year. the two parties are divided over how to cover the cost and republicans want to add language that will speed up construction of a controversial oil pipeline. the plan isn't popular with democrats, but republicans say

the 1700 mile project running from candidate to texas would create jobs. >> if that bill comes over to us, we will make changes to it and i will guarantee you that the keystone pipeline will be in there when it goes to the united states senate. >> lawmakers have until december 31 to find common ground, they aren't taking any chances. the senate is working on a plan b that would extend the tax break until february, allowing lawmakers to head home and tackle the issue in the new year. tara for cbs news, capitol hill. now that payroll tax cut bill also includes a provision to extend benefits for people who have been unemployed for a listening period of time. if the payroll tax bill or a short-term version of it does not pass, that means those benefits would vanish for millions of americans. >> baby jesus is back in his manger after being snatched tuesday night. he is part of a nativity scene at the central park shopping center in fredericksburg. the blue-eyed plastic figure was stolen once before back in

the barefoot bandit learned his sentence for his actions. 20-year-old colton harris-moore pleaded not guilty to theft and burglary charges and he was just sentenced to more than seven years in prison. his daring run from the law earned him international fame and even a movie deal. he stole as many as five planes, crash landed all of them, but under a plea deal, he cannot get to keep any of the money from the film deal. >> sentencing handed down for barry bonds. 30 days of home confinement and two years of probation for baseball's all-time home run king. however, the sentence was put on hold while bonds appeals. federal prosecutors were asking for a 15 month sentence. barry bonds was convicted of giving misleading testimony to a grand jury investigating steroid use among baseball players. >> still ahead on 9news now. first lady, michelle obama played santa while a marine plays cupid. we'll fill in the gap for you straight ahead.

only on channel 9. he may be the best known politician in virginia and he's not the governor yet, anyway. depending on which side of the political aisle you are, virginia attorney general may end in both cheers or boos. he reached national fame by taking on the obama administration. now he is causing friction in his own party. he sat down with me recently to explain his decision. >> but i signed up for responsibility that the people of virginia hired me for and that was to be attorney general. >> you don't plan to resign? ingly will not resign. >> that persona helped propel virginia attorney general, ken cuccinelli to the national stage. with his ultraconservative beliefs, he has become a tea party darling and was a panelist in a republican presidential debate on fox news. where he was especially hard on newt gingrich. >> after diewch cuccinelli

filed, he caused a rift in his own party. bill bowling had already decided to run with backing from governor bob mcdonnell. bowling has reportly said cuccinelli is putting personal ambition before the state's needs. >> it's not about being on opposite sides of this or that. we are working for what is best for virginia. it differs from other people's and i think voters are absolutely fed up with being told who they will vote for. they are going to choose it and god bless them. >> he surprised many at first in his unyielding support of thomas haynesworth, who was exonerated after spending 27 years in prison for rapes he did not commit. >> we have a criminal justice system run by human beings who will make mistakes. but you know, by golly, we have to be fast in correcting errors. >> he argued against the state's interest in the case and won. >> this will stand as the

greatest loss i ever have in my legal career. very proud of it. >> now i asked the attorney general about guns on campus and whether students should be allowed to carry guns. and he said that it should be left up to the board of visitors. although if adults have concealed weapons permits, he believes they should be allowed to carry weapons on campus. lesli. we have breaking news to tell you about. right now, traffic is all backed up around the key bridge. it is not an unusual thing, but we have to tell you what's going on. the bridge is being closed because two people are having some medical issues. officials are trying to keep that bridge closed, but not for long. still, there are significant traffic disruptions and you should expect them in georgetown, in particular, and of course the surrounding communities there. commuters try to avoid this area if you can. we'll of course stay on it, but again, major, major traffic issues around the key bridge tonight. >> michelle obama is urging

people to give to charities over the holiday season. the first lady delivered 800 toys donated by white house staff so the joint base at anacostia bowling, the gifts are going to the marine corps' toys for tots campaign and be distributed to military families. but mrs. obama received a surprise of her own. an invitation from a marine to be his date at next year's marine corps ball. the first lady told lance corporal she would love to go, but he has to go through her husband first. imagine if that was your neighbor. tis the season. the owner of this house is making it a rocking holiday season. the home in springfield, missouri, is outfitted with 120 ,000 lights and christmas figures. people come from everywhere to take it in. it's a huge operation so that local youth groups can come in

and set up all those lights and eventually take them down. we do lights, but we don't do lights like that. >> 120,000. they only have 600,000 at the mormon temple. that's a lot of lyings. >> lights. >> we have a little bit of rain south of town. the headline is colder air. temperature correction as we like to say. we are about 20 degrees cooler now than we were this time last night. let's start with the big picture. we'll zoom in. we have this one little storm. it's about the only thing on the map. passing to our south, producing rain in through southern maryland. it has been mixed with sleet at times. got it off of facebook that is mixing with sleet. we are looking at a little bit of mixed precipitation in west virginia. but it's going to be out of here quickly, and if you're d.c. north, you aren't going to see anything but clouds. you do not need to take your umbrella. i would bundle up because temperatures are in the 30s. live doppler 9,000.
